As the name suggests it’s a cancer in the breast of a person. Previously only female species were observed effected by this disease but in the recent years it is found that some of the males are also falling prey to breast cancer. This disease is generally seen among matured women in the age group of 50 years and above. Every year lots of women become victim of breast cancer that ultimately leads to their death.

Our medical science has not yet reached to the roots of this disease, however during the recent years our scientists and experts in the related fields are continuously progressing in the fight against breast cancer. Today one can find many options in the treatment of breast cancer and can opt according to the stage and requirements of the disease.

Stages of breast cancer The disease of breast cancer can be divided into many stages according to the symptoms and the nature of occurrence. The measure of the tumor inside the breast also plays an important role in deciding the stage of the disease. The different stages can be described into three parts as follows:

- Early stage- The early stage of breast cancer can be subdivided into these three different stages:

1. Stage 0- in this stage there is no evidence of cancer cells breaking through the normal tissue.

2. Stage I- In this stage the cancer cells are seen breaking through or invading the neighboring tissue and in this stage the tumor measure upto 2 cm.

3. Stage II- In this stage the tumor measure at least 2cm or upto 5cm and the cancer start spreading in the lymph nodes under the arm on the same side of the cancer.

- Lower stage- The lower stage of breast cancer is divided into sub stages described as under:

1. Stage III A- In this stage the tumor measures more then 5cm and the cancer spread through the lymph nodes and the nodes are sticking to the surrounding tissues.

2. Stage III B- In this stage a tumor of any size start spreading in the breast skin, lymph nodes and includes inflammatory breast cancer.

- Advanced Stage- the advanced stage known, as the stage IV is the most crucial stage of breast cancer where the tumor spreads beyond the breast, underarm, and internal mammary lymph nodes. The tumor can also spread to lungs, liver, bones or brains ultimately leading to death of the person.

Symptoms and diagnosis

There are many symptoms showing the occurrence of breast cancer, listed as under:

- Inverted nipple - Nipple discharge - Nipple rash - Cysts - Breast pain

The above symptoms if observed the person should immediately consult a doctor and should discuss about the required treatment. The best treatment of breast cancer is the early detection of the disease. Of all the cases that went to trial only 27% of them were won by the plaintiffs in these 75 counties. This is a large indication that most of these malpractice suits are not legit, otherwise there would be more of these cases won.

Close to 19,000 medical malpractice payment reports were made in the US last year according to the Annual Report, National Practitioner Data Bank, US DHHS. This is an absolutely staggering number.

It is estimated that about 25% of all the doctors in the United States get sued on an annual basis. This means that if you are a doctor, especially if you are a surgeon, you have a one in four chance of being hit with a lawsuit each year you are in practice. Makes you wonder why anyone would want to be a doctor in this country.

It is also estimated that between 50 and 65% of all doctors in the United States are sued at least once in their career. That gives you less than a 50% chance of getting through your career without an incident.

What is even more staggering is that of all the malpractice payment reports made world wide, over 80% of those payments were made by United States doctors with the whole rest of the world accounting for just 20% of all payments made for malpractice.

Even interns are not immune from this problem as over 1500 malpractice suits were filed against interns last year alone.

There is no question that these statistics point to an alarming and growing problem in the United States. Unless measures are taken to prevent fraudulent lawsuits, which many of these are, the problem is only going to get worse.

You will find many very qualified companies with good staffing software products. These products will utilize different technologies and different approaches to how they implement and train your company. The choices will be many, the approaches varied, and the results in some cases may be very good and in other cases you may find yourself with a staffing software solution that was over hyped and under delivered.

What can you do to insure the best possible result? Below are our six suggestions for evaluating staffing software and the companies that are providing those solutions:

1. Know what you want.

Spend time with the different players in your company and solicit their input on what your new solution should contain. Develop a decision matrix that you can use to evaluate the different staffing software solutions. Understand that no solution will match all of the requirements, at some point you will find that you may have to make a decision to exclude some desired features for the benefit of the total solution.

2. Evaluate the company.

Can you ‘test-drive’ the software so that you can get a hands-on feel for how the application will be utilized in real-life? Make sure that you can do this on your own, away from the sales person.

6. Evaluate the total package price.

Once you determine the solution you like and you are talking about pricing, ask yourself if you are comfortable that all of the costs are outlined and easily understandable? Will the sales rep guarantee you that the actual costs will not exceed the quoted price?

These are just some things to consider. Appellate Division Dismisses Claim After Plaintiff Failed To Name Company As Asbestos Supplier

A worker’s failure to identify a defendant as a supplier of the asbestos product to which he alleges exposure dooms his claims, the New York Appellate Division, Fourth Department affirmed on April 28 in Gorzka v. Insulation Distributors, Inc.

Matthew Gorzka sued a number of defendants, alleging that he developed injuries related to his workplace exposure to asbestos. Defendant IDI moved for and was granted summary judgment by Justice James B. Kane. Plaintiffs appealed.

The court upheld the decision, stating that IDI had met its burden by establishing that Gorzka never identified it as a supplier of any asbestos product to which he alleged exposure. Plaintiffs’ failure to name IDI as a supplier in his response to its interrogatories is an admission that it was not the source of asbestos-containing product to which he alleges exposure. The court held that Gorzka’s evidence showing that IDI supplied asbestos-containing products to his employer is insufficient to create a reasonable inference that he was exposed to those products.

There has been a great deal of discussion about asbestos legislation in recent months. Still, federal legislation that would create a $140 billion trust fund to handle asbestos claimants is unlikely to come up for a vote on the Senate floor in the near future, and alternatives in the House of Representatives are also stalled.

Sources said leaders in the Republican Party will not bring S. 852, the Fairness in Asbestos Injury Resolution Act, back to the Senate floor until they are sure they have the 60 votes necessary to overcome the budget point of order.

The bill was on the Senate floor once already this year. At that time, Sen. John Ensign, R-Nev., raised a budget point of order that the Senate failed to overcome by a 58-to-41 vote on Feb. 14, sending the bill to the Senate Budget Committee. Sen. Arlen Specter, R.-Pa., and other supporters were quoted at the time as saying they would try to resurrect the bill, but sources now say Specter could have as few as 57 votes in support of the measure.

Sources said the bill’s path is further obstructed because the Senate is considering immigration and pension reform. Sources said that little progress had been made on the bills and that work on them could continue until Memorial Day. Medical criteria legislation is likewise stuck. Sen. John Cornyn, R.-Texas, recently met with lobbyists and other interested in the bill, but sources said little progress was made.

In order to maintain consistency and quality control in a franchise company the franchisor or master franchise must continually do training. When a new franchise is opened there is the initial training, however as things change and new methods are discovered which are more efficient, new training must also occur. Ongoing training is the key to maintain the brand name.

It must be stipulated in the franchisor agreements that there will be associated costs for such ongoing training. In fact, regulators of franchising in many states as well as the federal level require this issue be addressed in the franchisor agreements and disclosure documents. Below is a copy of a clause that I put into all of our franchise agreements;

3.6.5 On-Going Training and Associated Costs

Franchisee will be exclusively responsible for paying any and all fees, charges, travel, living and other expenses and compensation incurred by Franchisee and their managers and crew leaders in connection with attending these programs, seminars and courses including any registration fee that may be charged by Franchisor or the training providers.

A business name can be a huge factor in the ultimate success or failure of the entity. Unfortunately, many people fail to give a lot of thought to it prior to moving forward. There are many factors to consider including something memorable, a name related to your area of work and, potentially, the availability of the domain name.

Picking a business name is like getting married. You are going to have to stick with it till the bitter end. Once they associate your business with a certain name, making a change will be disastrous. Once you pick something, stick with it.

Naming Your Business

If you are going to be married to your business name, you need to make sure the bride isn’t already married to another suitor. There are four significant issues to consider.

Initially, you must determine whether the name is already being used in your state. The Secretary of State controls the names of all corporations, LLCs and partnerships. Most also have a web site where you can conduct name searches. Even if you are a sole proprietor, you should check the name against those already registered in the state database. If the name is being used, you will need to consider an alternative.

Assuming the name passed must with the Secretary of State, you should check it against existing trademarks file with the Patent and Trademark Office. The “PTO” maintains an online database. As with the Secretary of State, you can conduct an online search to make sure no other business is using it.

In this day and age, many businesses incorporate a web site as part of their business model. If you are in this boat, you need to check to see if the business name is available as a domain. If it is, you should register it immediately. If not, you can either change your business name again or focus on a domain name incorporating your service or product instead of the business name.

Avoiding Problems

You business could be devastated if you do not take these precautionary steps. Imagine the negative impact on your business if the name has to be changed three years down the line. Take a breath before you select a business name. Like a spouse, it can be either a good or bad choice.
