Stop Collection Agency Harassment

Owing a debt does not automatically subject you to harrassing, threatening and other inappropriate collection agency behavior. Some collection agencies go too far with what I call “renegade collectors” they will repeatedly call you at your home and/or business, threaten to send a marshall over to serve you with lawsuit papers or send intimidating letters, appearing to come from an attorney or law firm, stating that you will lose your car, wages and other property if you do not pay your debt! It does not matter that you failed to pay a debt or that you can not afford to pay your debt at this time no one should intimidate, threaten or harrass you or coerce you to give out personal or financial information. Inappropriate collection procedures can intimidate you into paying for costs that may not even be your responsibility.You are protected by the law from innapropriate collection procedures.

The Federal Fair Debt Collection Practices Act, the New York City Consumer Protection Law Regulation 10 and New York State Statute, General Business Law, Article 29-H, (the “State Statute”) all prohibit threatening, harrassing and intimidating collection procedures. For instance, the State Statute prohibits a collection agent from (a) threatening to communicate with your employer prior to that agent obtaining a judgement against you, (b) communicating with your family or household at such frequency or at such unusual hours as can reasonably be expected to be abusive or harrassing, or (c) simulating any legal or judicial process or appearing to be authorized, issued or approved by the government or an attorney to collect a debt.

Also, if the collection agent sends you a letter demanding you pay without the reuired notice under the federal law regarding your confidentiality, your rights to dispute the debt an dgiving you the appropriate 30 days to respond, then the debt collector is automatically liable to you for any damages plus three times the amount of your damages. Each violation of the State Statute is a seperate misdemeanor offense. You can file charges with the State Attorney General or your County District Attorney and also request a restraining action against the collection company to stop it from continuing abuse and harrassment.

If you feel abused or harrassed by a collection agency, call that agency and get the name and address of the owner/president. Send your written complaint, by certified mail, return receipt, to the owner/president and include in your letter that you “believe that agency is violating the Federal Fair Debt Collection Practices Act and other state and local laws and that you will (a) file complaints with the Attorney General or the District Attorney’s office (subjecting the collection company to misdemeanor charges) and (b) request a restraining action against the collection agency.” If the collection company continues to abuse and harrass you, then go ahead and file your charges and complaints .

2) What do you charge and what is your fee structure? (You’ll want to know the most you’ll have to pay as well as how much you have to pay upfront. Many DUI lawyers charge a flat fee, which is a set amount for your case whether or not it goes to trial. Some lawyers charge an hourly fee. Others have staggered fee structures that break things into phases. They may charge a flat fee up until trial. If the case goes to trial then there’s another fee to pay. What To Expect If You Are Charged With a Crime.

Although most people never expect to be charged with a crime, there can come a time when that can happen. No matter which type of crime you are charged with, the proceedings will usually happen in a predetermined way. First, a warrant will put for your arrest. If a warrant is issued against you, you will usually be notified of the warrant by being served. Being served means that a police officer will locate you and deliver your warrant papers in person. On rare occasions, a person is arrested before being served with a warrant. In these cases, the arresting officer must show the warrant papers within a reasonable amount of time after the arrest has been made.

After you have been arrested, you will be taken to the police station to be booked. Being booked means that you will be fingerprinted and a file will be opened regarding your case. After being booked, you will generally spend a short amount of time in jail while you await your initial hearing and arrange payment for bail.

While you are in jail, you are allowed to contact an attorney. Any person charged with a crime has the right to seek legal representation. It is very important that you at least meet with an attorney before your initial hearing. If you cannot afford an attorney, or you have not chosen an attorney yet, the court can and must appoint a lawyer for you.

During the initial hearing, you will be asked to make a plea of guilty, not guilty or no contest. Your attorney will advise you as to which plea is most favorable for your situation. Even if you are guilty you may opt to plead not guilty. Some defendant’s choose to do this if they feel that the prosecutor does not have enough evidence against them to prove their case. If you plead not guilty, you will be given a trial in which it is the responsibility of the prosecution to prove your guilt. If you plead guilty or no contest, you will not be given a trail, rather you will go straight to a sentencing hearing.

If you are proven not guilty at your trial, you will be released from custody. If you are found guilty, you will be given a sentencing hearing.

A sentencing hearing is a hearing that allows all parties involved in your case to express the facts involving your case that may affect your sentence. These parties could include your accuser, yourself or persons who are defending your case.

After the hearing the judge will consider all evidence presented and then make a decision regarding your sentencing. Your sentencing could include additional jail time, monetary fines, community service or mandatory treatment programs. Depending on the severity of your crime, the evidence against you and your initial plea, the degree of sentencing could vary greatly. For smaller crimes, sentencing may only include a small fine and no jail time.

To insure that all of your rights are protected and that you receive the least sentencing possible, it is important that you hire a competent attorney and become knowledgeable about all of your rights.

A spin-off of the popular TV series Everybody Loves Raymond, King of Queens first hit the airwaves in the Fall of 1998. The show follows the life of Doug Heffernan (played by comedian Kevin James), a package delivery man for IPS (far different from UPS for you litigious-minded readers out there), and the show utilizes much of the same marital and relationship humor found in Ray Romano’s blockbuster sitcom. King of Queens revolves around the life of Doug Heffernan, a hard-working, sports-loving parcel delivery man living in Queens, New York. In his thirties, and married to a lovely woman named Carrie (Leah Remini - who played Carla’s daughter on the hit show Cheers), Doug spends most of his non-working hours basking in the glow of his state-of-the-art 70-inch TV with two buddies who share his fanatical love of sports, Spence (Patton Oswalt) and Deacon (Victor Williams). But Doug’s personal paradise suffers a devastating blow when Carrie’s widowed father Arthur (Jerry Stiller of Seinfeld fame) moves in with the couple. Doug’s TV fantasy room is converted into an in-law suite, and after several failed relocation attempts, the TV is pushed into the garage… Now Doug and Carrie must learn to share their palace with an eccentric, and oftentimes annoying, father/father-in-law with a penchant for messing up the couple’s well-grounded routine…

Being A Police Officer Is Dangerous Work

We all know that being a police officer can be a dangerous job; there are high speed pursuits, knife wielding youths, inner-city riots and of course climbing up two rungs of the three foot ladder.

Proudly police officers in Lancashire and deal with hardened criminals will have difficulty climbing a couple of feet off the ground. Officers installing roadside electronic speed equipment are now having to attend health and safety training to teach them how to climb a couple of rungs of a stepladder.

When officials from the Health and Safety Executive spotted officers moving equipment from one location to another they decided that the police men and women involved needed specialised training from Lancashire Fire and Rescue to deal with this dangerous situation.

As a result, the 125 officers involved were banned from dealing with equipment that required use of a stepladder until they have completed the training course.

The local MP Ben Wallace referred to the situation as “bureaucracy gone mad” and went on to state that the training was a waste of the officers time and public money.

Brown waives any worker who works “at height” i.e. not on the ground is required to undertake training regardless of the fact that in this case the officers never even reached a height of one meter.
