Once we had a franchisee who was sued by an employee who hurt his finger at the carwash and then did not show up for two-weeks, told no one and then he was served with a lawsuit. The employee had only worked there for two-days. The lawsuit went on for about six months and cost our franchisee about $22,000 and thankfully the lawsuit was won by our franchisee. Good news right? Well, not if you consider the $22,000 he lost at a time when he was going to add on awnings to his detail center to detail twice as many cars. That would have brought him in $20,000 per month.

With the extra money he could have hired three new people and eventually bought another location on the other side of town and hired 25 more people, thus providing jobs. You see when Lawyers become a vehicle for unscrupulous people to harass and terrorize businesses and citizens, everyone loses and of course this is why everyone wants to ge rid of all the lawyers. Marketing Authorisation: Distinction Between Food Additives and Medicinal Products

The case HLH Warenvertriebs GmbH and another v Germany (Joined cases C-211/03, C-299/03 and C-316/03 to C-318/03) was decided by the Court of Justice of the European Communities (First Chamber).

The applicants, HLH Warenvertriebs GmbH and another, intended to import into Germany and market certain products that were on the market as food supplements in the Netherlands. They planned to market the products also as food supplements. The applicant applied for marketing authorisation to market the products in Germany as food supplements. The applicants requested the German federal ministry for consumer protection, food and agriculture to adopt a general decision concerning marketing authorisations, pursuant to national law. The German Federal Ministry refused and they brought proceedings before the regional administrative court against this refusal. The court dismissed their actions. The main ground on which the proceedings were dismissed was that the products were medicinal products, not foodstuffs.

The applicants appealed to the higher administrative court. This court then stayed proceedings and referred the case to the Court of Justice of the European Communities (”European Court”) for a preliminary ruling regarding the interpretation of a number of provisions of Community law, in particular:-

Novel foods and novel food ingredients (Parliament and Council Regulation (EC) 258/97);

Articles 28 and 30 of the EC Treaty;

The Community code relating to medicinal products for human use (Parliament and Council Directive (EC) 2001/83);

The general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety (Parliament and Council Regulation (EC) 178/2002);
and
The approximation of the laws of the member states relating to food supplements (Parliament and Council Directive (EC) 2002/46).

The European Court decided:

In order to classify a product as a medicinal product or as a foodstuff, all the characteristics of the product had to be taken into account as established in the initial stage of the product i.e. where it was mixed, the method by which it was used and whether with water or with yoghurt.

Regulation 178/2002 (No 4 above) constituted an additional set of rules in relation to Council Directive (EC) 2002/46 (No 5 above).

It was only the provisions of Community law specific to medicinal products which applied to a product that satisfied equally the conditions for classification as a foodstuff and the conditions for classification as a medicinal product.

The competent authorities in member states had to:-

use the pharmacological properties of a product to ascertain, in the light of the potential capacities of the product, whether it might, for the purposes of the second subparagraph of art 1(2) of directive 2001/83 (No 3 above), be administered to human beings with a view to making a medical diagnosis or to restoring, correcting or modifying physiological functions in human beings.

establish the risk to health of human beings of using this product in the context of the classification of the product as a medicinal product.

A product which constituted a medicinal product within the meaning of directive 2001/83 (No 3 above) might be imported into another member state only upon acquisition of a marketing authorisation issued in accordance with the provisions of that directive, even where it was lawfully marketed as a foodstuff in another member state.

The concept of ‘upper safe levels’ in art 5(1)(a) of directive 2002/46 (No 5 above) was not of importance for the purposes of drawing a distinction between medicinal products and foodstuffs.

In evaluating the risks that foodstuffs or food supplements might constitute for human health by a member state, the member state has to take into account whether there is a nutritional need in the population of that member state. However, the absence of such a nutritional need did not in itself justify, either under art 30 EC (No 1 above) or under art 12 of directive 2002/46, a complete ban on marketing foodstuffs or food supplements lawfully manufactured or placed on the market in another member state.

Article 1(2) of regulation 258/97 (No 1 above) should be interpreted to mean that a food or a food ingredient had not been used for human consumption to a significant degree within the Community if, when all the circumstances of the case were taken into account, it was established that that food or food ingredient had not been consumed in a significant quantity by humans in any of the member states before the reference date.

A national court could not directly refer questions regarding the classification of products to the European Food Safety Authority (EFSA). If the EFSA delivered an opinion, say, in a case forming the subject-matter of a dispute pending before a national court, this might constitute evidence that the national court could take into consideration in the context of that dispute.

How Autocorrect in Microsoft Word Can Help You With Acronyms

The world today has gone literally gone acronym crazy. Every industry has its own plethora of acronyms to bamboozle the uninitiated. Acronyms are also often a source of great pain for those people who have to create procedure documents for their industry. There is a way to survive this turmoil through the power of Autocorrect and it will definitely save you time.

Autocorrect was originally developed by Microsoft to help those people using Microsoft Office and in particular Microsoft Word overcome typing issues but it has also become the saviour to those working in an acronym world.

I hear you saying it, HOW!

An acronym in essence is short couple of characters that have a special meaning for example in Australia we have a term called the Australian Business Number which has an acronym abn. If you were producing a lot of documents that refer to the term Australian Business Number you would find it takes a little time to right that whole name. In many cases it would be inappropriate to actually use the acronym. What Autocorrect allows you to do is to program into the application the term abn and associate it with the full name Australian Business Number.

What this means is that when you are typing your documents and you need to refer to the term Australian Business Number, you simply type in abn and as you press the space bar Microsoft Word will then convert the acronym abn to Australian Business Number.

So why does it do this?

Like I mentioned before, Autocorrect was really developed to overcome the issue of people mistyping words. Essentially as you type Autocorrect checks to see if what you are typing is correct and if its not it will correct it with the options in the Autocorrect list. Some of the common typing mistakes you might incur would cna instead of can. If you open Microsoft Word and type in cna it will automatically correct it to can.

Autocorrect is actually available in all Microsoft Office Applications which include Microsoft Word, Excel, PowerPoint, Access, Publisher, Outlook and FrontPage. Now the really cool part about this is that if you setup an Autocorrect entry in say Microsoft PowerPoint, it will also be available in all of the other applications. This means that you are going to save time both in the initial setup but also whilst you are creating these documents.

If you find that when you tried the example I gave to you before that it did not convert the misspelt word to the correct word then most likely the AutoCorrect function has been turned off. To turn it on in Microsoft Word 2003 simply choose the Tools menu and then choose AutoCorrect Options. You will see a checkbox next to the words “Replace Text as you type”. If the checkbox does not have a tick next to it then you need to click once on the check box to activate it. Then finish off the process by pressing the OK button.

There are three autocorrect entries which I think are absolutely essential to know and that is how you can insert the Trade Mark Symbol, Registered Symbol and Copyright Symbol without using the symbol command. All you do is type the following -

(tm) - Creates the Trade Mark Symbol

(c) - Creates the Copyright Symbol

(r) - Creates the Registered Symbol

Autocorrect is certainly one of the tools that I think is really cool but is often misunderstood and not used to its full potential. Using AutoCorrect in this way will save you hours of time when dealing with acronyms. It might take a little time setting up your acronyms but once its completed it will save you countless hours and make you far more efficient and effective in using the Microsoft Office Suite.

Movie Review: Ice Age 2

“Ice Age 2: The Meltdown” is about three prehistoric animalsManny the Mammoth (Ray Romano), Diego the Saber tooth tiger (Denis Leary) and Sid the Sloth (John Leguizamo) narrowly escaping a melting paradise of water parks, geysers and tar pits. The world as they know it is coming to an end. The animals must run for their lives and fight other critters that threaten their existence.

For an animated adventure, Ice Age 2 is riveting and intense. The movie is pure “fight or flight,” a term equated with stress response. (Often stress causes people to fight back or run away, rather than responding in a cool, calm and collected manner)

Personally, I found Ice Age 2 to be more stressful than entertaining. I couldn’t laugh when vultures swooped down from the sky, screeching, “All unattended children will be eaten.” Fortunately, such comments flew right over my children’s heads. The kids laughed themselves silly as Scrat the Saber tooth squirrel (Chris Wedge) fumbled to gather acornsa feat of mental gymnastics and Twister (minus the board game.)

My kids also laughed at the tribe of dancing mini-sloths who crown Sid the “Fire King.” Their silly songs, copycat chanting and dancing are kind of cute. (I glanced at my kids, and noticed they were dancing along in their seats) It’s one of the brightest spots in the movie. It is also funny watching Ellie (Queen Latifah,) a mammoth who thinks she is a possum. In spite of all evidence to the contrary, Ellie cannot be persuaded to face reality. Fueling the fantasy are Ellie’s two wisecracking possum brothers, Crash and Eddie (Josh Peck & Seann William Scott.)

Towards the end of the movie, Manny the Mammoth suggests, “Let go of the past, so you can have a future.” It’s a beautiful sentiment, but my child misunderstood what it meant. His take: “Speaking of the future, what’s for lunch?” Bottom line: Ice Age 2 is a great kid’s movie, if you don’t take it too seriously.
